THIS SYNOPSIS IS FOR INFORMATIONAL PURPOSES ONLY. The Naval Air Systems Command intends to award a Firm Fixed Price contract to BAE Systems, Austin, Texas. This award will be on a sole source basis. The contract will provide for Digital Control Display Units (DCDU), DCDU repairs to return the units back into a serviceable condition, and Technical Services. The applicable NAICS Code is 334511, Search, Detection, Navigation, Guidance, Aeronautical, and Nautical System and Instrument Manufacturing. The statutory authority permitting other than full and open competition is 10 U.S.C. § 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1: "Only one responsible source and no other supplies or services will satisfy agency requirements," and more specifically 10 U.S.C. § 2304(d)(1)(B) as implemented by FAR 6.302-1(a)(2)(ii): "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in- (A) Substantial duplication of cost to the Government that is not expected to be recovered in competition; or (B) Unacceptable delays in fulfilling the agency's requirements." This is not a commercial buy and therefore the Government does not intend to use the provisions of FAR Part 12 for this acquisition. This synopsis is published for informational purposes only.
