The Naval Air Systems Command (NAVAIR) intends to award a sole source Firm Fixed Price (FFP) BOA order to BAE Systems, Information and Electronic Systems Integration (BAE), Greenlawn, NY for the production of the AN/UPX-42(C) Digital Interrogator (DI), Part Number (P/N) 4092100-0501. This BOA order is for the correction of Trouble Reports, verification of the new software build, and delivery of qualification reports as authorized by an Engineering Change Proposal (ECP). BAE, as the sole designer, developer and manufacture of the AN/UPX-42(C) is the only company with the unique knowledge, experience, special skills, facilities, manufacturing techniques, and technical data required to perform these requirements. This acquisition is being pursued on a sole source basis under the statutory authority of 10 U.S.C 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “only one responsible source and no other supplies or services will satisfy agency requirements.” The Government does not intend to use the provisions of FAR part 12 for this acquisition.
