The Naval Air Systems Command (NAVAIR) intends to negotiate and award a Firm-Fixed Price (FFP) delivery order under Basic Ordering Agreement (BOA) N0001916G0022 to Thales Avionics Frances, SAS on an other than full and open competition basis, in accordance with FAR 6.302-4 “International Agreement”. The contract will be for the procurement of Optimized TopOwl (OTO) Helmet Mounted Sight and Display (HMSD) Components required to support the UH-1Y and AH-1Z aircraft for the Czech Republic. FAR 6.302-4(a)(2) dictates that Full and open competition need not be provided for when precluded by the terms of an international agreement or a treaty between the United States and a foreign government or international organization, or the written directions of a foreign government reimbursing the agency for the cost of the acquisition of the supplies or services for such government. As such, this procurement is not intended for full and open competition. This pre-solicitation notice is not a request for competitive proposals. However, interested parties are requested to submit a capability statement for the purpose of determining whether to initiate a competitive procurement. All responses received by the Government within fifteen (15) days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete the proposed contract action based upon responses to this notice is solely within the discretion of the Government. Award Synopis The Naval Air Systems Command (NAVAIRSYSCOM) awarded a Firm-Fixed Price (FFP) delivery order N00019-21-F-0226 under Basic Ordering Agreement (BOA) N00019-16-G-0022 to Thales AVS France SAS for the procurement of Optimized TopOwl (OTO) Helmet Mounted Sight and Display (HMSD) Components required to support the UH-1Y and AH-1Z aircraft for the Czech Republic. Funds in the amount of $9,706,504 were obligated at the time of award. This effort was synopsized on 11 June 2020 under notice number N00019-20-RFPREQ-PMA-276-0146-(OTOGFE). This procurement was awarded in accordance with the statutory authority permitting other than full and open competition under 10 U.S.C. 2304(c)(4), as implemented by the Federal Acquisition Regulation (FAR) 6.302-4 “International Agreement.” This effort was fully funded by the Foreign Military Sale (FMS) case. FAR 6.302-4(a)(2) dictates that Full and open competition need not be provided for when precluded by the terms of an international agreement or a treaty between the United States and a foreign government or international organization, or the written directions of a foreign government reimbursing the agency for the cost of the acquisition of the supplies or services for such government.
