Naval Air Systems Command (NAVAIR) intends to award a sole-source delivery order to an existing Basic Ordering Agreement to perform a software update to version 4.70 for APKWS II Guidance Sections. As part of the software update effort, the contractor shall perform Pre and Post software update inspections, and perform agreed to repairs on all Guidance Sections and containers. This contract will be utilized by the Unites States Army (USA), the United States Navy/United States Marine Corps (USN/USMC), and the United States Air Force (USAF). These requirements will be procured in accordance with the statutory authority permitting other than full and open competition under Title 10 U.S.C 2304(c)(1), as implemented by FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." As the sole designer, developer and manufacturer of the APKWS II Weapon System, BAE Systems Electronic Solutions (BAE) is the only source that currently possesses sufficient requisite knowledge, engineering expertise, aircraft integration information, and technical data required to perform these efforts. No other source has the technical qualification and necessary resources to perform the work described herein, nor will any other supplies or services satisfy the Government's requirements. A determination by the Government not to compete the proposed contract modification based upon responses to this notice is solely within the discretion of the Government.
