The Naval Air Systems Command intends to award a Firm Fixed Price contract to Cobham Advanced Electronic Solutions, Inc., 305 Richardson Road, Lansdale, Pennsylvania. This award will be on a sole source basis. This contract will implement an engineering change developed under a previous contract to modify the existing Vertical Polarized (VPoL) Antenna Assembly to the AN/ALQ-99 Low Band Transmitter (LBT). The proposed contract will require the implementation of an engineering change to modify the existing LBT system to improve performance and increase reliability of the highly specialized VPoL Antenna System currently in use and will include the design, manufacture, integration, and testing of up to 221 VPoL Antenna Assemblies. The statutory authority permitting other than full and open competition is 10 U.S.C. § 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1: "Only one responsible source and no other supplies or services will satisfy agency requirements," and more specifically 10 U.S.C. § 2304(d)(1)(B) as implemented by FAR 6.302-1(a)(2)(ii): "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in- (A) Substantial duplication of cost to the Government that is not expected to be recovered in competition; or (B) Unacceptable delays in fulfilling the agency's requirements." As the sole system designer, developer, integrator and manufacturer of the LBT, Cobham has unique expertise regarding the design, engineering and performance details of the LBT and VPoL Antenna that are necessary to modify the VPoL and successfully integrate it into the existing LBT Transmitter and AN/ALQ-99 system. The term of the contract is expected to a base plus two option years. This is not a commercial buy and therefore the Government does not intend to use the provisions of FAR Part 12 for this acquisition. This synopsis is published for informational purposes only.
