The Naval Air Systems Command (NAVAIR) intends to award a sole source, Cost Plus Fixed Fee (CPFF) order on contract N00019-17-G-0013 to BAE Systems Information and Electronic Systems Integration of Greenlawn, New York (BAE) to upgrade the existing APX-123A Operational Flight Program (OFP) Version 7.02 software for stable platform integration using Software Version 7.30 as a baseline to enhance operational capability by providing improved functionality for the APX-123A Transponder system. BAE, as the sole designer, developer, and manufacturer of the APX-123A System is the only company with the unique knowledge, experience, special skills, facilities, manufacturing techniques, and technical data required to support the above-mentioned CXP system. This acquisition is being pursued on a sole source basis under the statutory authority of 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements". The Government does not intend to use the provisions of FAR Part 12 for this acquisition.
