The Naval Air Systems Command (NAVAIR) intends to award contract actions to The Boeing Company (Boeing), Seattle, WA on an other than full and open basis. These efforts shall be procured pursuant to 10 U.S.C. 2304(c)(1) and FAR 6.302-1, "Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements." The contract actions will cover P-8A Engineering Change Proposal (ECP) 6 retrofit activities to include procurement of A-Kits. Additionally, the contract actions will include initial aircraft modification and installation of A-Kits and Government Furnished Equipment (GFE) B-Kits, repair incident to modifications, Non-Recurring Engineering (NRE) for design, fabrication, and correction of deficiencies, and associated logistics support requirements. Initial retrofit activities are planned to occur between FY20 and FY25. Boeing is the sole designer, developer, and manufacturer of the P-8A airframe, as well as the sole integrator of the avionics systems, and therefore is the only responsible source with the requisite knowledge, experience, and technical data that can meet the Government's requirements without resulting in unacceptable delays in fulfilling the Navy's requirement to procure ECP 6 A-kits and initial ECP 6 aircraft modifications. The P-8A weapon system consists of a basic Boeing commercial 737-800 ERX air vehicle modified to meet Navy requirements, and numerous systems and subsystems for avionics, communications, mission, and weapon capabilities. P-8A ECP 6 provides a significant modification to the P-8A baseline airframe and avionics systems, and includes new airframe racks, radomes, antennas, sensors, and wiring, while incorporating a new combat systems suite with an improved computer processing and security architecture capability at the Higher than Secret level, a Wide Band SATCOM system, an ASW Signals Intelligence capability, a Minotaur track management system, and additional communications and acoustics systems to enhance search, detection, and targeting capabilities. P-8A ECP 6 requires access to Boeing proprietary commercial 737-800 ERX technical data with sufficient rights to use for airframe and avionics modification purposes. The production and delivery of ECP 6 A-kits require a complete Technical Data Package (TDP) in order to ascertain the engineering specifications necessary to manufacture the components. As the P-8A Original Equipment Manufacturer (OEM), Boeing is the only source that has the knowledge and access to the technical data necessary to manufacture ECP-6 A-Kits. The Government does not possess a TDP that can be provided to an alternate source. Boeing has indicated that it is unwilling to deliver a TDP with sufficient Government rights for third party distribution due to the proprietary nature and commerciality of the 737 aircraft and other systems within the platform. The timeline to compete and qualify a second source is estimated to take over 5 years based on the actual time expended on the P-8A Increment ECP 6 system design and development requirements to date. Therefore, award of the ECP-6 A-Kits to any other source would result in unacceptable schedule delays, which would result in a failure to meet the Navy's requirement to field ECP 6 warfighting capabilities in 2024. Initial ECP 6 aircraft modifications will be conducted concurrently with ECP 6 Integrated Testing requirements, resulting in a number of aircraft modifications being conducted prior to the final Installation Data Package (IDP) Technical Directive (TD) being verified and available to support the stand-up of an alternative source in the 2025 timeframe. The initial installations of ECP 6 therefore requires detailed technical data defining the specifications, tolerances, and processes necessary to modify the airframe prior to the time the IDP will be completed. As a final IDP will not be completed in time to support these initial installations, Boeing as the OEM is currently the only source that has the knowledge and access to technical data necessary to perform these initial modifications. This notice of intent is not a request for competitive proposals. Interested persons may submit a capability statement identifying their interest and capability to respond to this requirement. The Government will consider any capability statements submitted by identified closing date of this announcement.
