The Naval Air Systems Command (NAVAIR) intends to award a firm fixed price sole source contract to Viasat, Carlsbad, CA, for the procurement of updated encryption algorithms with the attendant license and associated logistics data (herein after referred to as "crypto modernization firmware") for installation into all fielded and spare Link 16 Small Tactical Terminals (STT) used in AV-8B aircraft. This contract action will be issued on a sole-source basis under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Viasat is the sole owner of the data required to produce the crypto modernization firmware. The Government does not intend to use the provisions of FAR Part 12 for this acquisition. The basic contract will procure crypto modernization firmware for installation onto approximately 146 AV-8B Link 16 STTs. The contract will contain options as follows: Option 1 - crypto modernization firmware for installation onto approximately 12 spare AV-8B Link 16 STTs; Option 2 - crypto modernization firmware for installation onto approximately 17 Italian AV-8B Link 16 STTs; and Option 3 - crypto modernization firmware for installation onto approximately 9 additional spare AV-8B Link 16 STTs. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, responsible interested parties may submit a capability statement in which they identify their interest and capability to respond to this requirement. A determination by the Government not to compete this procurement based upon responses to this notice is solely within the discretion of the Government. The Government will not pay for any information received.
