The Naval Air Systems Command (NAVAIR) intends to negotiate and award a delivery order under Basic Ordering Agreement (BOA) N00019-16-G-0001 on a sole source basis to The Boeing Company, 6200 JS McDonnell Blvd., St. Louis, MO 63134-1939. The Delivery Order placed under the BOA will provide for the procurement of the Harpoon Block II Guidance Control Unit (GCU) Upgrade for Taiwan Navy (TN). Effort will include retrofit of TN Harpoon Block II missiles from GCU to Integrated GPS Anti-Jam System (IGAS) software version 3.7 Selective Availability Anti-Spoofing Module (SAASM) GCU. Contract award is anticipated for the first quarter of calendar year 2020 and is anticipated to be for 18 months. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302. This acquisition is being pursued on a sole source basis under the statutory authority of 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The Boeing Company is the sole designer, developer, manufacturer and integrator of the Harpoon/SLAM-ER Weapon System and its related equipment. The Boeing Company alone has the technical data, experience, requisite knowledge, technical expertise, special skills and facilities required to provide the supplies anticipated under these orders. The Boeing Company is the sole owner of technical data for Harpoon/SLAM-ER and therefore is the only responsible source that can meet the Government's requirement. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. There is no commitment by the Government to issue a solicitation, make an award or awards, or to be responsible for any monies expended by any interested parties before award of a contract for the effort mentioned above.
