The Naval Air Systems Command (NAVAIR) intends to award a sole source, Cost Plus Fixed Fee contract to BAE Systems, Information and Electronic Systems, (BAE) Greenlawn, NY for a tech refresh of the AN/UPX-50(C) Digital Interrogator (DI). The contractor shall redesign the DI in order to resolve parts obsolescence, and implement solutions to achieve compliance with the latest specifications, qualifications, and certification standards. BAE, as the sole designer, developer and manufacture of the AN/UPX-50(C) is the only company with the unique knowledge, experience, special skills, facilities, manufacturing techniques, and technical data required to perform these requirements. This acquisition is being pursued on a sole source basis under the statutory authority of 10 U.S.C 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “only one responsible source and no other supplies or services will satisfy agency requirements.” The Government does not intend to use the provisions of FAR part 12 for this acquisition.
