JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC) AUTHORITY: 10 U.S.C. 2304(c)(5) or 41 U.S.C. 3304(a)(5) REFERENCES: • In accordance with FAR 6.302-5 Authorized or Required by Statute • FAR 6.302-5(b)(5) Sole source awards under the HUBZone Act of 1997 - 15 U.S.C 657a • FAR 19.1306 HUBZone Sole Source Awards • FAR 13.106 (b) (1) (i) states that, "The contracting officer may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization). The following documentation constitutes the rationale for this decision. DOCUMENTATION: (1) Requiring Activity and Contracting Activity: a. Requesting Activity: Defense Finance and Accounting Service (DFAS) Department of Military Pay Operations (DMPO) Ft Meade, MD 2234 Huber Road Fort Meade, MD 20755-5122 b. Contracting Activity: DFAS Columbus Contract Services Directorate Bldg. 21/2B218 3990 E. Broad St. Columbus, OH 43213-1152 (2) Nature and/or Description of the Action Being Approved: This procurement is to obtain onsite or offsite interpreting services for various meetings, training, etc. for the deaf and hard of hearing employees (hereinafter referred to as deaf) on an as needed basis at Department of Military Pay Operation (DMPO) in Ft Meade, Maryland through Sole Source HUBZone procedures to Applied Development, LLC (CAGE 6ST51) for one year and two additional option year periods. (3) Description of Supplies or Services Required to Meet the Agency's Needs (Including the Estimated Value): Obtain onsite or offsite interpreting services for various meetings, training, etc. for the deaf and hard of hearing employees (hereinafter referred to as deaf) on an as needed basis at Department of Military Pay Operation (DMPO) in Ft Meade, Maryland. (4) An Identification of the Statutory Authority Permitting Other Than Full and Open Competition: FAR 6.302-5(b)(5) Authorized or required by statute and FAR 19.1306 HUBZone sole source awards. (5) The Nature of the Acquisition Requires Use of the Authority Cited Due to the Following: The Agency is working toward meeting its small business goals for FY 2019. Specifically HUBZone goals. (6) Efforts to Ensure that Offers are Solicited from as Many Potential Sources as is Practical: This JOFOC will be posted to fbo.gov along with the PWS and a statement that DFAS intends to negotiate solely (as prescribed in FAR 19.1306) with Applied Development, LLC, 618 Ploy Street, Baltimore, MD 21201, DUNS 078516013. (7) Determination that the Anticipated Cost to the Government Will be Fair and Reasonable: The Contracting Officer anticipates the cost to the Government will be fair and reasonable based on previously awarded prices deemed fair and reasonable based on competition and the IGCE. (Reference HQ042319P0010.) (8) Description of Market Survey: A request for quotes (RFQ) was issued to fbo.gov for interpreter services for twelve weeks supporting Ft Meade as a total small business set aside. Of the twelve responses received, only one reply was from a HUBZone company (Applied Development, LLC). A search for additional HUBZone companies servicing this area was performed on the Small Business Administration (SBA) Dynamic Small Business Search for the NAIC code 541930. Of the eighteen companies servicing the State of Maryland, only two listed had capability statements matching the requirement, Applied Development, LLC and The Language Doctors. The 2nd company, the Language Doctors, did not respond to the previous RFQ, market research attempts, nor indicate any expressed interest in this requirement via any form of communications. (9) Other Facts Supporting the Use of Other Than Full and Open Competition: The Agency's HUBZone small business goal has been difficult to achieve so an increased emphasis is being placed on this program. (10) List of Sources that Expressed, in Writing, an Interest in the Acquisition: Applied Development, LLC (a HUBZone business) and eleven small businesses responded to the previous RFQ. (11) Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition Before any Subsequent Acquisition for the Supplies or Services Required: Not applicable.
