Approval for the use of other than full and open competition, to increase the total aggregate contract maximum of the NAVFAC Southwest Multi-Disciplinary A-E Services IDIQ for the Naval Special Warfare Command projects in Southern California, by $6,800,000 from $30,000,000 to $36,800,000 was granted via J&A 20-09 on February 21, 2020, to allow for award of additional task orders and modifications using design-bid-build (DBB) design and construction methodology, add capacity to allow Post Construction Award Services (PCAS) be awarded for all projects once designs are complete and construction activities begin, and include a contingency reserve for unseen modifications related to design changes that may arise for ongoing projects, with no extension to the contract completion date. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1) or 41 U.S.C. (a)(1), as implemented by FAR 6.302-1, which permits contracting when there is only one responsible source or no other supplies or services will satisfy agency requirements.
