United States Transportation Command (USTRANSCOM) (PEO-T) intends to negotiate a sole source contract with Tecolote for continued annual distribution, maintenance, and support. The sole source Justification and Approval is attached to comply with the public display requirements of FAR 6.305. The proposed contract action will provide annual renewal to obtain updates and security patches. Since the U.S. Government has perpetual rights to the software, there are no license fees to use the software; however, annual renewal is required to obtain updates, fix bugs, and receive security patches. The resultant firm-fixed price contract will be for a 1-year base period and four 1-year option periods for a total of 5 years (60 months). Based upon market research, Tecolote is the only source capable of providing the necessary support for the ACEIT software. Furthermore, no other companies have been authorized to resell or redistribute ACEIT as of May 2021. The statutory authority for other than full and open competition is 10 USC 2304 (c) (1), only one responsible source and no other supplies or services will satisfy agency requirements.
