The Defense Health Agency Contracting Activity (DHACA), Western Markets Contracting Division (WMCD), San Diego, intends to negotiate and award a firm fixed price contract for BioFire FilmArray extended warranty and preventative maintenance services in accordance with Federal Acquisition Regulation (FAR) 13.501(a) Sole Source acquisitions and FAR 13.106-1(b)(1)(i), only one source being available to meet the Government’s needs, to: BioFire Defense LLC 79 W 4500 S STE 14 Salt Lake City, Utah 84107-2663 The North American Industry Classification System (NAICS) code for this requirement is 811210 - Electronic and Precision Equipment Repair and Maintenance; the business size standard is $34.0M. The objective of this sole source award is to procure extended warranty and preventative maintenance services for four (4) BioFire FilmArray 2.0 in support of Naval Health Clinic Lemoore (NHCL) Laboratory Department. Period of Performance (POP): Base Year: 15 November 2023 to 14 November 2024 Option Year 1: 15 November 2024 to 14 November 2025 Option Year 2: 15 November 2025 to 14 November 2026 Option Year 3: 15 November 2026 to 14 November 2027 Option Year 4: 15 November 2027 to 14 November 2028 Manufacture Equipment ECN Serial Number BioFire FilmArray 2.0 052727 2FA08559 BioFire FilmArray 2.0 052706 2FA01866 BioFire FilmArray 2.0 052705 2FA03485 BioFire FilmArray 2.0 052703 2FA08174 a) Perform service maintenance to industry standards in accordance with manufacturer requirements. b) Perform recalibration, maintenance, and quality inspection as required per instrument and shipping will be at the expense of the Contractor. c) The Contractor is responsible for all shipping costs, including insurance, for preventive maintenance and equipment repair. d) Perform all software upgrades and training free of charge. e) Make repairs to the extent necessary (as determined by inspection tests or disassembly) to ensure a functional system that will efficiently serve its intended purpose. f) Provide only the work necessary to restore the equipment to a serviceable/operating condition by adjustments, replacement parts, or minor repairs when it is determined that extensive repairs and parts replacements are not necessary. g) Ensure that original design and functional capabilities will not be changed, modified, or altered. h) Provide suitable modern recommended repair equipment/tools required for the satisfactory execution of all repairs made. i) Furnish manufacturer OEM approved lubricants and lubricate wear points within the equipment. j) Extend to the Government all commercial warranties or replacement parts, consistent with standard industry practices. k) Maintain an adequate spare parts inventory on parts with a history of high failure/replacement rates. BioFire Defense LLC is the Original Equipment Manufacturer (OEM) of the FilmArray 2.0. OEM provided a sole proprietor letter stating they are the sole provider and do not authorize any third-party vendors to perform maintenance and repairs on their equipment. The work shall be performed at: Naval Health Clinic Lemoore (NHCL) 937 Franklin Avenue Lemoore, CA 93246 Based on market research, BioFire Defense LLC is the only source that can meet the Government’s minimum requirements for the FilmArray services for NHCL. This notice of intent is not a request for competitive proposals, and no solicitation document exists for this requirement. Sources interested in responding to this notice are required to submit a capability statement that includes management and technical data and cost information, in sufficient detail and with convincing evidence that clearly demonstrates the capability to provide the required services at NHCL. Capability statements shall not exceed six (8.5 x 11 inch) pages using a font size no smaller than 10-point. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information or submissions that only ask questions will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source purchase order.
