The Defense Commissary Agency (DeCA) intends to sell certain Commercially Valuable Information as defined in 10 USC §2485(h), including raw product movement data, hereinafter referred to as “Scanner Data,” generated by the front-end cash register systems used in the DeCA commissaries operated worldwide. Firms that purchase the Scanner Data in accordance with (IAW) the approved agreement (License Agreement) will be granted a license to use the Scanner Data IAW the agreement. DeCA anticipates the creation of multiple License Agreements in response to this notice. The License Agreement(s) will be effective beginning August 5, 2022, or upon the dissolution of DeCA’s current Scanner Data License agreements, whichever occurs first. The purchasing firm(s) will be granted a ten-year agreement from the effective date, which shall continue uninterrupted, with automatic annual renewals, until 2032. Please carefully review the attached License Agreement. If your firm intends to enter into an agreement with DeCA for the purchase of Scanner Data, please complete the following and fill-in sections of the License Agreement, and return a scanned copy of each to Dan Lindsey at daniel.lindsey@deca.mil no later than Thursday, June 30, 2022 at 2:00 PM EDT.
