This is not a request for competitive proposals or quotations. The Missile Defense Agency (MDA) intends to solicit, negotiate and award a sole source contract to Original Equipment Manufacturer (OEM), Raytheon Company (Raytheon), 1151 East Hermans Road, Tucson, AZ, 85756-9367, for the sustainment, upgrade, repair, and maintenance of the Exoatmospheric Kill Vehicle (EKV) in the fielded Ground-Based Interceptor fleet. This contract will be referred to as the Exoatmospheric Kill Vehicle Sustainment Contract (ESC). The proposed acquisition will be a Sole-Source Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract to Raytheon per FAR 6.302-1(a)(2)(ii): Only one responsible source and no other supplies or services will satisfy agency requirements - Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in a) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or b) Unacceptable delays in fulfilling the agency’s requirements. In accordance with FAR 5.207(c)(16)(ii), all responsible sources may submit a proposal which shall be considered by the agency. Submissions shall occur within 15 days of the posting of this notice.
