United States Special Operations Command (USSOCOM) has the need to increase the maximum contract ceiling value of a current Indefinite Delivery, Indefinite Quantity (IDIQ) contract, H92401-18-D-0005, for continued purchase of Satellite Deployable Node-Lite (SDN-L) terminals and ancillary equipment and spares with Tampa Microwave, LLC, 16255 Bay Vista Drive Suite 100, Clearwater, FL 33760-3127. As previously announced in the Request for Information (RFI), (RFI_SDN-L_2021) posted on 25 August 2021, the above contract is currently set to expire on 31 July 2023. Based upon the approved Basis of Issue (BOI) quantities for the triband terminals yet to be fielded, and the associated sustainment efforts required until contract expiration, the current contract ceiling value is not adequate. The existing ceiling was established utilizing an independent government cost estimate (IGCE) which consisted of inaccurate unit prices for complete tri-band Terminals, as well as incorrect BOI quantities for both terminals and spares which has caused a shortfall in the required ceiling value. Therefore, it is necessary to increase the current contract ceiling value by $62.1M, from $70M to $132.1M. The modification will be executed under the authority of FAR 6.302-1(a)(2)(ii), only one source is capable of satisfying the agency's requirements. This determination is based on the fact that Tampa Microwave is the sole manufacturer of this terminal and all associated ancillaries. As such, the terminal hardware, software, and associated technical data necessary for production and to provide the related ancillary equipment are proprietary to Tampa Microwave. Moreover, the Government has determined that acquiring a new SDN-L terminal at this time would cause substantial duplication of cost to the Government that is not expected to be recovered through competition and would result in unacceptable delays in fulfilling the agency's requirements. Therefore, as outlined in the attached draft Justification and Approval (J&A), given the only recent fielding of these terminals, coupled with the fact that this contract is not set to expire until mid FY23, USSOCOM currently has no plans to purchase an alternate capability at this time. Therefore, the need for this ceiling increase is not solely based on the current capabilities of potential alternate terminals, but also how those increased capabilities (if any) would outweigh the substantial duplication of cost to the Government and without incurring significant delays in fulfilling our mission requirements that would be associated with introducing this new capability at this time. Based upon the responses received in response to the initial RFI, our internal knowledge of current capabilities available within Industry, as well as, future offerings, the Government determined that it is not in the Government’s best interest to execute a new source selection for the SDN-L terminal at this time. Reference the attached draft Justification and Approval (J&A) for additional information. That said, IAW FAR 5.207(c)(16)(ii), all responsible sources may submit additional capability statements that will be considered by the agency. The original Sources Sought synopsis in support of Solicitation H92222-14-R-0027 for the existing USSOCOM JHU/APL contract, was posted to Federal Business Opportunities (www.fbo.gov) on 16 December 2014. No responses were received, and contract H92222-15-D-0004 was issued with a $405,000,000.00 contract ceiling and a five year ordering period of 27 February 2015 to 26 February 2020. USSOCOM continues to have requirements to establish and/or maintain an essential capability for (i) theoretical analyses, exploratory studies, and/or experiments in various fields of science and technology; and (ii) engineering and/or developmental work for the practical application of investigative findings and theories of a scientific or technical nature, to include production in limited quantities not to compete with the private sector.
