This is a Notice of Proposed Contract Action under the FAR Part 12 Acquisition of Commercial Products and Commercial Services, and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 334515 (Instrument Manufacturing for Measuring and Testing Electricity and Electrical Signals) with a small business size standard of 750 employees. The Government requires procurement of a Vector Network Analyzer System, and intends to negotiate a sole-source award for this requirement with Keysight Technologies, Inc. 1900 Garden of the Gods Rd., Colorado Springs, CO 80907-3423. Keysight Technologies, Inc. is the only known commercial vendor capable of offering an integrated solution consisting of a 4-port Vector Network Analyzer (VNA) with phase coherent wideband signal analysis up to 40 GHz, fully calibrated wideband signal source for device characterization at measurement port, VNA extender modules specifically designed to work with the wideband VNA, integrated software applications for amplifier measurement parameters, and application support. Keysight Technologies, Inc. is behind the few existing testbeds in the world at millimeter wave and terahertz devices, and there are no other known commercial vendors that offer an integrated solution as detailed above to meet the Government’s requirements. While Keysight Technologies, Inc. does maintain a network of authorized resellers for its products, market research has yielded that Keysight Technologies, Inc. direct is offering the Government the most favorable pricing for this requirement, which will not be passed onto authorized resellers. Accordingly, as aforementioned, the Government intends to award a sole-source contract for this requirement to Keysight Technologies, Inc. direct. This is a notice of proposed contract action and not a request for competitive proposals; however, all responsible sources may submit a capability statement or proposal, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 15 May 2024. A Sole Source Justification will be attached to the subsequent Notice of Award in accordance with applicable regulation.
