This is a Notice of Proposed Contract Action under the FAR Part 12 Acquisition of Commercial Items, and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 332311 with a small business size standard of 750 employees. AFRL requires twelve (12) prefabricated containers meeting the following specifications: Prefabricated Container, 8’ x 20’ x 8’6”H Structure Elements o 20' Standard ISO Shipping Container with ISO corners and forklift pockets o One (1) insulated partition wall to divide the container into a 9’9” x 6’9” insulated work room and an 8’6” x 8’ uninsulated storage/mechanical room. One (1) Interior, Insulated, 3070, Flush Swing Door, with door gear installed in the partition wall. Includes condensate drain. o Two (2) 18” W x 12” H Stormproof Louver vents w/ insect screens For ventilation in the storage room Miscellaneous o Two (2) open frame server racks 28.875” x 36U o One (1) Cable management system o One (1) Vidmar 6 drawer lockable cabinet 27.75” x 60” o Two (2) padded folding chairs o One (1) wall mounted first aid kit o One (1) toolkit o One (1) 6’ little giant ladder w/ wall mount o One (1) wall mounted, 15A, 45’ retractable cord reel o Two (2) 3’ long sections of Unistrut for securing the antennas next to the HVAC unit. o Four (4) container castor wheels, urethane on iron, 10,000 lb rating Includes one set of 4 castors for use on one of the containers at a time Other o Container fully painted to protect from corrosion o Building ships assembled FOB Destination Shipping to Rome, NY The Government intends to negotiate a sole source contract with: UH Structures Inc. dba Ebtech Industrial 2241 Industrial Drive Connellsville, PA 15425 The Government has determined that no other source has commercial offerings that can meet this requirement. The containers will be used to house and operate miliary and commercial radios, as well as computer equipment in support of a Government program. The required specifications include all the options required to allow the container to keep all the equipment safe from the elements to include holding the internal environment of the container at a certain temperature and humidity in varying climates. Additionally, the containers will need to be provided to AFRL/RI ready to connect external power and be ready to populate with all the radio and computer equipment. Ebtech Industrial has built similar containers for the DoD at locations all over the world and has experience in building shelters that will operate in the climates required, and is the only known vendor who can satisfy the requirement. This is a notice of proposed contract action and not a request for competitive proposals; however, all responsible sources may submit a capability statement or proposal, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 31 May 2023. A Sole Source Justification will be attached to the subsequent Notice of Award in accordance with applicable regulation.
