This is a Notice of Proposed Contract Action under FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR PROPOSALS. The associated North American Industry Classification System (NAICS) code is 811310 with a size standard of $12.5 Million average annual receipts. AFRL/RITQ, in support of the Quantum Information Science (QIS) Program, requires extended warranty coverage on Government owned lasers systems. The Government intends to negotiate a sole-source contract with M Squared Lasers, Inc., Cambridge Innovation Center, 1 Broadway, 14th Floor, Cambridge, MA 02142. The Government has determined that other companies’ products and services do not meet, or cannot be modified to meet the Government’s needs. Under the contemplated contract, M Squared Lasers Inc. will provide the extended warranty coverage on the following systems: These extended warranties will cover the following systems: SolsTiS Serial number: 230442 SolsTiS Serial number: 590379 SolsTiS Serial number: 501065 Sprite Serial number: 700848 ECD-X Serial number: 374334 ECD-X Serial number: 329916 ECD-X Serial number: 165528 Sprout Serial number: G18NDBH20160422 Sprout Serial number: H12H20161014 Sprout Serial number: G18NDBH20170619 Sprout Serial number: G15NDBH20170630 The highly specialized laser systems covered contain designs proprietary to M Squared Lasers, the manufacturer of the systems. Due to the proprietary nature of the system designs M Squared is the only source capable of warrantying these units. Servicing these units requires access to company specific proprietary configuration and calibration data. The extended warranty covers equipment troubleshooting and service when some type of repair is required. The warranty covers the disassembly, replacement and reassembly of parts of defective equipment. This obligation extends to the costs of moving, packing and transporting the equipment, if required for refurbishment or replacement. This is a notice of proposed contract action and NOT a request for competitive proposals. However, all responsible sources may submit a capability statement or proposal, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 31 August 2023. A Sole Source Justification will be attached to the subsequent Notice of Award in accordance with applicable regulation.
