This is a Notice of Proposed Contract Action under the FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 811219 with a small business size standard of $20,500,000 in average annual revenue. The Government intends to negotiate a sole source contract a radiometer repair with: ATS Services, Ltd 35 Auriga Drive, Unit 213 Ottawa ON K2E 8B7 1-613-221-9815 POC: Larry Malenfant The requirement is for the repair the RPG Model LWP-U72+U72.5/82.5 radiometer, serial number R-LWP-U72+82 - 10/001. This includes repair of various defective and damaged components, replacement of internal SATA DOM, replacement of cooling fans, and replacement of radome sheet with custom internally fabricated hardware, custome firmware and software. Original equipment manufacturer is Radiometer Physics GmbH (RPG), Werner-von-Siemens-Str. 4, 53340 Meckenheim, Germany. Market research to date has determined that no other source can meet the requirements, most notably ATS is the authorized US distributer and agent for RPG. A party other than ATS servicing, altering, or performing the requirement described in this notice would void existing warranties and agreements. This is a notice of proposed contract action and not a request for competitive proposals; however, all responsible sources may submit a capability statement, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 15 SEP 2019. A Sole Source Justification will be attached to the subsequent Notice of Award in accordance with applicable regulation.
