Notice: This is a short summary of the intent to single-source and is for informational purposes only. 23d CONS has the need for an easy-to-use interface for electronically exchanging, reviewing, and archiving design and construction project documentation in the cloud. The objective is to save time, reduce costs, and decrease the amount of paper associated with projects. Furthermore, the software shall provide increased transparency, consistency, and accountability, resulting in fewer delays and lower costs. Primavera Submittal Exchange Cloud Service is a software developed and wholly owned by Oracle and has been identified as the single-source that can meet the needs of the Government. Other business entities are not exempt from the non-manufacturer rule because they are: (1) not inherently engaged in the manufacture of the product (2) are supplying a product manufactured by an OTSB concern (3) there is no waiver to the non-manufacturer rule for NAICS 518210. There are no business concerns with a primary line of business of wholesale trade of the software because they do not provide any added value (ie. delivery of the software, customer support, or end user training). IAW FAR 13.106-1(b), the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. 82 CONS has already proved the concept that Submittal Exchange is effective and substantial duplication of cost to the Government is not expected to be recovered through competition. The government requests that initial feedback, comments, and questions be sent within fifteen (15) calendar days of the date of publication of this notice on SAM.gov.
