As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows: EVALUATION-COMMERCIAL ITEMS (OCT 2014) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1. Technical Capability: Meets brand name or equal Government requirement/specifications as identified in each CLIN. Contractors providing “as equal” items must provide the manufacturer, model/numbers, and specification data adequate in determining whether the products meet the salient features provided for the solicitation. For supplies, the Government will consider offers/quotes only from “authorized resellers/distributors” of the offered manufacturers. 2. Price: Lowest Price Technically Acceptable. Will be evaluated in accordance with FAR 13.106-3. 3. Delivery: Contractor must be able to meet requested delivery time. 4. Following information must be provided with quote: a. Small Business Status/Categories as appropriate b. Company point of contact with email and phone number c. CAGE Code & DUNS number d. Delivery lead time (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
