INTENT TO SOLE SOURCE Computer Assisted Legal Research (1 Month Bridge Action) The 42nd Contracting Squadron at Maxwell AFB, AL hereby give notice of its INTENT TO AWARD A SOLE SOURCE BRIDGE CONTRACT to RELX, Inc. (dba LexisNexis) for the Air Force Legal Operations Agency (AFLOA) to purchase one (1) month of access to their Computer Assisted Legal Research (CALR) database system. The North American Industry Classification System (NAICS) Code is 519130 and the small business size standard is 1,000 employees. IMPORTANT NOTES: 1. The Government is currently working a forthcoming competitive acquisition planned for this requirement. The competitive award will consist of a base year with four (4) each one (1) year options. The purpose of the one (1) month sole source action is to allow the Government access to the CALR database system during coordination of appropriate approvals and funding for the competitively awarded contract. The competitive award is anticipated to have a start date of 1 Nov 19. Award of this one (1) month action to any company SHALL NOT guarantee award of the follow on contract to that company NOR shall it be used as a favorable evaluation criteria during selection for that contract. 2. This notice of intent is not a request for quotes and no solicitation is available. 3. A determination not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. Information received in response to this notice will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. 4. Respondents are discouraged from submitting any information deemed competition-sensitive or proprietary. 5. Respondents will not be reimbursed for any costs incurred in responding to this intent to sole source notice. Information submitted will not be returned to the respective respondents. 6. Oral submissions of information will not be considered in response to this notice. This sole source procurement is under the authority of FAR 13.106-1(b)(1)(i). This action will be a firm-fixed price contract for a period of performance of 30 Sep 19 to 31 Oct 19. Description of the Requirement: AFLOA has a requirement for CALR database access during the interim period of one (1) month between expiration of the current contract on 30 Sep 19 and the start of a new competitively sourced contract with a projected start date of 1 Nov 19. The CALR access required will provide the following: 1. Database menu access a. To include unlimited search, browsing, printing, electronic clipping services, images, research software, training, and support capabilities. b. Include the following subject matter: i. Federal Trial and appellate court decisions and rules. ii. Federal arbitration awards. iii. Military appellate court decisions and rules inclusive of the Court of Appeals for the Armed Forces, Air Force Criminal Appeals, Army Court of Criminal Appeals, Navy-Marine Corps Court of Criminal Appeals, Coast Guard Commandant Decisions on Appeal, United States Coast Guard Court of Criminal Appeals, and the Uniform Code of Military Justice. iv. Federal Appellate Court briefs. v. State appellate court decisions and state court rules. vi. Annotated United States Code. vii. Federal Register and Code of Federal Regulations. viii. State statutory codes and administrative codes. ix. Legislative history including the Congressional Record. x. Federal administrative agency decisions including those of the Comptroller General, the Merit Systems Protection Board, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, the Office of Personnel Management Compensation and Leave Decisions, all of the Boards of Contract Appeals and Employee Benefits Security Administration. xi. To include unlimited search, browsing, printing, electronic clipping services, images, research software, training, and support capabilities. b. Include the following subject matter: i. Employment law. ii. Contract law. iii. Health and safety law. iv. Criminal law. v. Civil litigation and procedure. vi. Real property law, including leases and landlord tenant law. vii. Tort law. viii. Personal injury. ix. International law. x. Conflict of laws. xi. Current UK and EU legislation. xii. Other databases currently included in the Contractor's system or added at any time during the contract period at either a standard or discounted per-search rate. This per search rate shall include access to the databases, searching, browsing, printing, and downloading. 5. User Database Access and Pass Thru a. Air Force i. Provide access through the web server that hosts the Federal Legal Information through Electronics (FLITE) system. b. Army i. Provide access through the web server that hosts the U.S. Army Judge Advocate General's Corps legal information technology and knowledge management portal (JAGCNet). c. Marine Corps i. Provide access directly via web browser. d. Navy i. Provide access directly via web browser. 6. Searching. a. The system shall accommodate both term and operator searching and natural language searching. b. The system shall provide at least two different types of citator facilities to include, at a minimum, case history citatory and general citator. 7. Availability. a. The system shall be available to all users at all times 365 days per year. 8. Customer Support. a. Provide technical assistance and answer questions by a toll free number in, at a minimum, the following countries: United States, Australia, Canada, England/United Kingdom, France, Germany, Japan, Mexico, and Taiwan. In those countries not provided a toll free number, customer support must be available through collect calls, online tickets, or email requests with a response within 60 minutes. 9. Training. a. Provide user training at no additional cost for persons covered by this contract at locations worldwide. After initial training, the Contractor shall continue to follow up on a routine basis to keep users informed as well as to provide advanced training. This training shall include content and use of databases, search and retrieval functions (including printing and downloading functions), and effective legal research strategies. All instructors provided by the Contractor shall be experienced with the services and products furnished under this contract, and the training shall be limited to those products and services.
