Award of a task order for out-of-scope work to remove and dispose of materials soiled with used oil (“Materials”) under existing contract N40192-20-D-1800 Environmental IDIQ Services for Hazardous Waste, Hazardous Material, Other Regulated Waste, and Spill Response at Joint Region Marianas, Guam with Landscape Management Systems, Inc. (“Contractor”). The requirement includes the disposal of Materials, to include oily rags and filters, soiled with used oil that have been stockpiled in containers at Building 1790 Conforming Storage Facility (CSF) on Naval Base Guam. FAR 6.302-2(a)(2) permits contracting without providing for full and open competition when the agency’s need for the services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Contractor is the only source capable of meeting the requirement without causing unacceptable delays as the Contractor operates the CSF, transports the Materials, and is already mobilized with the necessary workforce, equipment, and collection vehicles. Other contracting actions require protracted timelines for contract administration and mobilization of workforce, equipment, and collection vehicles that would not meet the urgent need. Delay in award of a task order will result in serious injury, financial or other, to the Government. (See attachment for full document)
