Notice of intent to solicit and negotiate with a single source in accordance with Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. This is a special notice prepared in accordance with FAR 5.203 - Publicizing and Response Time. US Army Corps of Engineers (USACE) - Omaha District intends to issue a Firm-Fixed Price contract to ETS-Lindgren, Inc., 1360 N Wood Dale Rd Ste G, Wood Dale, IL 60191 on a sole source basis. Description of Requirement: Provide and install nine 250 AMP High Altitude Electromagnetic Pulse (HEMP) filters in Building 1000 on Offutt AFB, NE. Filters shall be installed on the existing HEMP shield. The contractor will be expected to remove seven existing filters and install the new filters in their place. The remaining two filters will be installed in the locations of other 250 AMP filters that were previously removed for testing. All newly installed filters will be connected to the HEMP facility power supply by a licensed electrician. The replacement filters are required to work as part of a larger HEMP protection system to prevent power interruptions during operations. The newly constructed HEMP power system includes HEMP filters (including 1200, 600, 400 and 250 AMP) that are exclusively manufactured by ETS-Lindgren. Filters must be consistent with the HEMP system, having the precise sizing measurements and wiring configuration that will allow for proper fit and operation once installed. Only the ETS-Lindgren filters can meet all requirements for a fully integrated HEMP protection system. Authority: The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304(c)(1), as implemented by FAR, Part 6.302-1 "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". No other sources have been determined to be capable of conducting this work to provide the essential quality to address the project objectives. There have not been any alternate sources determined to be used or obtained competitively. It is the best value to the government to procure this work via sole source contract with ETS-Lindgren, Inc., as it is the most cost-effective option to accomplish this work. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The determination not to compete this proposed contract action is solely within the discretion of the Government. The NAICS code is 334515, "Instrument Manufacturing for Measuring and Testing Electricity and Electrical Signals". The size standard as defined by the U.S. Small Business Administration is 750.
