The Synopsis is updated to advise as follows: - Solicitation #SPE8EG-21-R-0003 for the Clear Outsert Assembly is now available on the DLA Internet Bid Board System (DIBBS). - Issue Date: Tuesday, June 8, 2021 - Close Date/Time: Thursday, July 8, 2021; 3:00PM EDT - The solicitation will provide for one (1) contract. The resultant contract will include a two-year base period and three (3),one-year option periods. _______________________________________________________ This acquisition is for a Firm-Fixed Price, Indefinite Delivery Indefinite Quantity (IDIQ) Contract for the manufacture and delivery of the Clear Outsert Assembly (NSN: 4240-01-529-8327). Avon Protection Systems, Inc. (CAGE: 1LEW5) is the only approved source for the item, Part Number: 5-1-4327. The item has technical data, some or all of which is subject to export-control of either the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR) and cannot be exported without prior authorization from either the Department of State or the Department of Commerce. Export-control includes disclosure of technical data to foreign persons and nationals whether located in the United States or abroad. This requirement applies equally to foreign national employees and U.S. companies and their foreign subsidiaries. DFARS 252.225-7048 is applicable to this data. The Defense Logistics Agency (DLA) limits distribution of export-control technical data to DLA contractors that have an approved US/Canada Joint Certification Program (JCP) certification and have completed the Introduction to Proper Handling of DoD Export-Controlled Technical Data and the DLA Export-Controlled Technical Data Questionnaire (both are available at the web address provided below). The contractor must also have approval by the DLA controlling authority to access the export-controlled data. Instructions for obtaining access to the export-controlled data can be found at: https://www.dla.mil/HQ/LogisticsOperations/EnhancedValidation/. DLA will not delay award in order for an offeror or its supplier to apply for and receive approval to access the export-controlled data. The solicitation number is SPE8EG-21-R-0003. FAR Part 12, Acquisition of Commercial Items and FAR Part 15, Contracting by Negotiation procedures will be utilized. The acquisition will be accomplished using Other than Full and Open Competition procedures in accordance with FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirement. The solicitation will provide for one (1) contract. Any resultant contract will be awarded to the responsible offeror, offering the lowest price, whose offer conforms to all of the terms and conditions set forth in the solicitation. The resultant contract will contain a two (2) year base period and three (3) one-year option periods. The contract maximum will be $43,739,749.90. The Clear Outsert Assembly is a Critical Safety and Chemical-Biological item. Contractor First Article Testing and Contractor Production Lot Testing is required for this acquisition. Delivery terms will be FOB Origin and Inspection/Acceptance at Origin. The Government required delivery schedule is 70 days after date of order. Buy American Act clauses apply. This synopsis should NOT be considered a Request for Proposal, Request for Quote, or Invitation for Bid. The Government is in no way obligated to purchase any material as a result of this notice. The estimated release date of the solicitation is June 4, 2021. The date is subject to change. A copy of the solicitation will be available through DLA Internet Bid Board System (DIBBS), https://www.dibbs.bsm.dla.mil/. All responsible sources will be able to submit a proposal which will be considered by DLA Troop Support.

Pursuant to Federal Acquisition Regulation (FAR) Part 10, the Defense Logistics Agency is issuing this Sources Sought Notice as a means of conducting market research to identify parties having an interest in and the resources to support this requirement (NSN: 4240-01-529-8327; Outsert, Clear, Assembly). This NSN is sole sourced to Avon Protection Systems, Inc. – (CAGE Code: 1LEW5), Part Number 71014/12. DLA Troop Support is researching the possibility of issuing a solicitation for the item under an Indefinite Delivery, Indefinite Quantity (IDIQ) type contract. If an award is made, the resultant award would not exceed a period of five (5) years. The annual estimated quantity for the item is 100,000 each. This Sources Sought Notices is issued solely for information and planning purposes and does not constitute a solicitation nor is this notice a Request for Proposal (RFP). This notice should not be construed as a commitment by DLA Troop Support for any purpose. Submission of any information in response to this market survey is purely voluntary.
