The sale covers intact, unbroken transformers classified as non-PCB under 40 CFR 761 because analysis shows <50 ppm PCBs or, absent analysis, nameplate data indicates non-PCB. Purchasers may not use a Statement of Intent destination in a state with stricter PCB regulation than 40 CFR 761 unless transformer PCB levels are below that state’s threshold; for example, CA, OR, and WA regulate PCBs above 5 ppm. If a leak is found during removal, the Generator will repair it, and the transformer may be removed only after the Purchaser, Generator, and Disposition Field Site Representative verify the repair. Export outside the U.S. for recycling is not authorized, and bids proposing such recycling will be rejected as nonresponsive. This is not a service contract.
