******* This is a Market Based Contract****** A.4 IFB Item Number Details: The fuels listed in this IFB are being sold for energy recovery only, in accordance with the RCRA exemption found at 40 CFR 2... ******* This is a Market Based Contract****** A.4 IFB Item Number Details: The fuels listed in this IFB are being sold for energy recovery only, in accordance with the RCRA exemption found at 40 CFR 261.2(c)(2)(ii). The fuel will only be sold to purchasers that can demonstrate the ability to comply with all local, state, and federal laws governing the use of off-specification fuels for energy recovery. The off spec mixed fuel being advertised for sale in this IFB may/will have contamination that may include water, dirt, and/or fuel oils. Upon request from the Purchaser, the Generator will provide a profile for each tank prior to the tank contents being removed to ensure the fuel can be sold for energy recovery. The tank profile may reference generator knowledge or analysis. The Purchaser may, at their own expense, obtain a small sample for lab analysis/test. All potential Bidders are advised to read all terms and conditions of this IFB prior to submitting their bids to ensure they have a complete and full understanding of all requirements under this contract for sale. The Purchaser is cautioned that some requirements for information are required before the start of work on this contract. This is NOT a Service contract
