The purpose of this amendement is to incude an updated SOW and provide Government responses to all RFI's. See attachments "SOW-Government Tower Installation Updated 16 April 2021" and "RFI and Government Responses - 120' Tower Installation" for details. The purpose of this amendment is to incorporate additonal clauses. See attachment "Solicitation Amendment 1_Tower Installation" uploaded 1 April 21 for details. The Government has a requirement for 120’ Government Tower Installation Near Base Museum Building 5295 at Edwards AFB, CA as indicated in the attached statement of work (SOW) (attachment 1). A Purchase order award is anticipated to be issued to the Lowest Price Technically Acceptable (LPTA). This solicitation uses simplified acquisition procedures contained in FAR Part 13 as well as Construction and Architect-Engineer Contracts contained in FAR Part 36. No Bid Gaurantees are required for this requirement. Bonds are anticipated to be necessary for this contract. Bonds shall be provided in accordance with Federal Acquisition Regulation (FAR) Clauses 52.228-2, Additional Bond Security (> $35K); 52.228-14, Irrevocable Letter of Credit; and/or 52.228-15, Performance and Payment Bonds--Construction (DEVIATION 2020-O0016). Proof of bonding is due 10 days from award. The applicable wage rates for this project can be found attached to this letter (attachment 2). The work will take place in Kern County CA. Liquidated damages have been determined to not be required on this contract action per the Contracting Officer. The estimated period of performance for this project is 90 calendar days after notice to proceed (NTP). Offer Acceptance Period: All offers submitted must be valid through 90 days from proposal due date. Notice to Offerors: Funds are presently available for this effort and award will be made to lowest price, technically acceptable quote. This is an "All or None" acquisition, incomplete quotes will not be considered. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs. In accordance with FAR 36.204(g) the estimated price range of this project is between $100,000. and $250,000. The purchase order as a result of this solicitation will follow the following Contract Line Item (CLIN) structure: CLIN 0001 - The contractor shall provide all management, labor, material, equipment, transportation, supervision and minimal designs to accomplish the work as outlined in the attached Statement of Work (SOW) dated: 8 March 2021. Project Title: Government Tower Installation near B5295, Project Number: FSPM-2018-00005-00002 The proposal submitted in response to this solicitation must be in compliance with the terms and conditions of this solicitation and attachments to include the SOW. Proposal submissions shall include the following: Technical and Managerial approach for meeting the requirements of the statement of work. An itemized breakdown of priced proposal. Breakdown should include details for (but not limited too) any labor, materials, equipment, design costs, and travel/diem if applicable. All travel/per diem shall be subject to Joint Travel Regulations. The Government will award a firm fixed priced (FFP) task order resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. This will be awarded to the lowest priced offeror who passes technical acceptability. The evaluation process will begin with the evaluation of all timely filed proposals starting with the lowest total price. If the lowest priced proposal is found to be technicall acceptable, award will be made to that vendor. Only ONE (1) award will be made from this solicitation. The following evaluation factors will be used in awarding this purchase order: Price Evaluation: Lowest price will be determined based on the total evaluated price (TEP). The TEP will be calculated as the sum of the offeror’s proposed price. The price proposal shall include quantities and prices for each construction work item IAW the SOW provided. Technical Acceptability: The Government will review the contractor’s proposed technical and managerial approach to verify it will result in successful contract performance. Technical Acceptability is a pass/fail basis. If a proposal fails it will be determinated to be not technically acceptable. A site visit for this project is deemed necessary and is scheduled for 8 Apr 2021. Attendance of the site visit is STRONGLY encouraged. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor’s records. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order: Document type. The Contractor shall submit payment requests using the following document type(s): CONSTRUCTION PAYMENT INVOICE (i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher. (ii) For fixed price line items— (A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer. (B) For services that do not require shipment of a deliverable, submit either the Invoice 2in1, which meets the requirements for the invoice and receiving report, or the applicable invoice and receiving report, as specified by the Contracting Officer. (iii) For customary progress payments based on costs incurred, submit a progress payment request. (iv) For performance based payments, submit a performance based payment request. (v) For commercial item financing, submit a commercial item financing request. (2) Fast Pay requests are only permitted when Federal Acquisition Regulation (FAR) 52.213-1 is included in the contract. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution.
