Darrow Contract Specialist, USPFO for Oregon P&C deannie.l.darrow.civ@mail.mil 503-584-3435 PERFORMANCE WORK STATEMENT (PWS) FOR GENERAL INFORMATION Description of Services/Introduction: The Contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to perform simulated enemy combative (OPFOR) scenarios as defined in this PWS except as specified in Section C-3 as Government Furnished Property (GFP) and services at Camp Umatilla. 1.1 Background: The 249 Regiment, Regional Training Institute (RTI) seeks to develop the abilities of Infantry the Advanced Leadership Course (ALC), Infantry Transition Course (ITC), and Infantry Military Occupational Specialty Transition Course (MOS-T) students to learn and adapt to the human dimension of the next battlefield, developing adaptive and flexible leaders capable of operating globally under a wide range of culturally diverse environments. The current curriculum is 19 days long, of which a majority is conducted in a classroom setting followed by a three-day field training exercise (FTX) where students are rotated through leadership positions. With each rotation, new missions are presented to students in a scenario-based environment that includes civilian role players to increase the complexity and uncertainty of the Operating Environment (OE). Each student is evaluated by the instructors while they are in a leadership position according to the guidelines set forth in the Army Leadership Requirements Model. 1.2 Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary, except as specified in Paragraph 3.0 as Government Furnished, to perform Civilians on the Battlefield (COB) Services, as defined in this PWS. 1.3 Objectives: The contractor shall participate in scenarios that are comparable to our past conflicts or likely conflicts in the near future. 1.4 Period of Performance: The Period of Performance shall be 1Base Year of 12 months. Base Period August 1, 2020-July 31, 2020 1.5 General Information 1.5.1 Quality Control: The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. As a minimum, the Contractor shall develop quality control procedures that address the areas identified in Attachment A, “Performance Requirements Summary.” After acceptance of the quality control plan the Contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system. The quality control will be given to the KO or the COR within 10 before the start of contract. 1.5.4 Recognized Holidays: 1.5.6 Unscheduled: Unscheduled gate closures by the Security Police may occur at any time causing all personnel entering or exiting a closed installation to experience a delay. This cannot be predicted or prevented. Vehicles operated by contractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the contractor employee’s installation driving privileges. 1.5.7 The contractor’s employees shall become familiar with and obey the regulations of the installation; including fire, traffic, safety and security regulations while on the installation. Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All contractor employees shall always carry proper identification with them and shall be subject to such checks as may be deemed necessary. The contractor shall ensure compliance with all regulations and orders of the installation which may affect performance. The Government reserves the right to direct the removal of an employee for misconduct, security reasons, or any overt evidence of communicable disease. Removal of contractor employees for reasons stated above does not relieve the Contractor from responsibility for total performance of this contract. 1.6 Security Requirements: The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the COR. The contractor and all associated subcontractor employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. The contractor shall ensure compliance with all personal identity verification requirements as directed by Department of Defense (DOD), Headquarters Department of Army (HQDA) and/or local policy. Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes. 1.6.1 Background Checks. Contractors shall obtain, at a minimum, a National Agency Check with Inquiries (NACI) in accordance with Army Regulation 25-2, Information Assurance Training, prior to starting employment under the terms of this contract. The Contractor shall forward investigation results to the Contracting Officer’s Representative within five days after contractors are hired. Moreover, the contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), and applicable installation, facility and area commander installation/facility access, and local security policies and procedures (provided by a government representative). 1.6.2 Anti-Terrorism; Level 1 Awareness Training (AT): All contractor employees, including subcontractor employees, requiring access to Army installations, facilities, and controlled access areas shall complete Anti-Terrorism Level 1 AT on or before the contract start date. The contractor shall submit certificates of completion for each applicable contractor and subcontractor employee to the COR within 15 calendar days after completion of training for all employees and subcontractor personnel. Level 1 AT is available at http://jko.jten.mil/courses/atl1/launch.html 1.6.3 Access and General Protection/Security Policy and Procedures. Contractor and all associated sub-contractors’ employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshall Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes. 1.6.4 iWATCH Training: The contractor and all associated subcontractors with an area of performance within an Army-controlled installation, facilities or area shall brief all employees on the local iWATCH program. This local developed training shall be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR or the KO. This training shall be completed on or before the contract start date. The contractor shall report completion for each contractor employee and subcontractor employee to the KO within 20 calendar days after completion of training. 1.6.6 Information Assurance (IA) Awareness Training. All contractor employees and associated sub-contractor employees must complete the DOD Information Assurance Awareness Training and sign an Acceptable Use Policy (AUP) before issuance of network access and annually thereafter. Training is available at: https://ia.signal.army.mil/DoDIAA/. Once training has been completed, the Contractor shall provide completion certificates to the COR within ten calendar days. The Contractor shall ensure that contractor employees complete this training within 15 calendar days after beginning employment. 1.6.8 Physical Security: The contractor shall safeguard all Government property provided for contractor use. At the close of each work period, Government facilities, equipment and materials shall be secured. 1.7 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the contracting officer will apprise the Contractor of how the Government views the Contractor's performance and the Contractor will apprise the Government of problems. The contractor shall resolve any outstanding issues by taking appropriate action to rectify all problems that were addressed by the government in each meeting. These meetings shall be at no additional cost to the Government. 1.8 Contracting Officer Representative (COR): The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of Government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially regarding changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order. 1.9 Contract Manager: The contactor shall designate a CM who shall ensure performance under this contract. The name of this person, and an alternate who shall act for the contractor when the CM is absent, shall be designated in writing to the KO. The CM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The CM shall work through the KO to resolve issues, receive technical instructions, and ensure adequate performance of services. The CM shall ensure that all contractor employees do not perform any services outside the scope of the contract without an official modification issued by the KO. The CM shall ensure contractor employees understand that services performed outside the scope of the contract are performed wholly at the expense of the contractor. 1.10 Identification of Contractor Employees: Contractor personnel will not be required to obtain and wear badges. No later than 24 hours before entering the installation the Contractor shall provide a written list of all role player names. These personnel will be met outside the gate and escorted on to the Camp Umatilla training area. All contractor personnel attending meetings or working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression that they are Government employees. The contractor shall ensure that all documents or reports produced by contractor personnel are suitably marked as contractor products or that contractor participation is appropriately disclosed. The contractor’s status as a “contractor” shall be predominantly displayed in all correspondence types (to include signature blocks on e-mail) and dealings with Government or non-Government entities. PART 2 DEFINITIONS & ACRONYMS 2. DEFINITIONS AND ACRONYMS: 2.1. DEFINITIONS: 2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime contractor. 2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government. 2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor if that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract. 2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated within the Performance Work Statement. 2.1.5. DELIVERABLE. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports. 2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal. 2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property. 2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards. 2.1.9. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance. 2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of a product or service shall meet contract requirements. 2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor. 2.1.12. WORKDAY. GOVERNMENT FURNISHED SERVICES; FACILITIES; UTILITIES, ETC. 3.1 Property: The Government will furnish the materials, equipment and services necessary for the contractor to perform services outlined in this PWS. 3.2 Materials: The Government will provide the scenario scripts, rules of engagement, simulated village and bazaar settings with corresponding atmospherics to support training. 3.3 Equipment: The Government will provide scenario-appropriate costumes and clothing, non-firing simulated weapons (i.e. “rubber ducks”), tents, maps and assorted scenario-specific intelligence material. 3.4 Services: The Government will provide parking spaces within the cantonment area for civilian vehicles, transportation to and from the scenario locations inside the training area and portable latrines in the training area. 3.5 Utilities: All utilities in the facility will be available for the contactor’s use in the performance of this contract. The contractor shall instruct employees in utilities conservation practices. The contractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount. PART 4 CONTRACTOR FURNISHED ITEMS & SERVICES 4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES: 4.1 General: Except for those items specifically stated to be Government-Furnished in Paragraph 3.0, the contractor shall furnish everything required to perform these services as indicated in Paragraph 1.1. 4.2 Infantry training will be conducted despite inclement weather. The contractor will provide clothing and equipment that will enable scenarios to be trained in hot, cold, rainy, windy, or other adverse weather conditions. 4.3 Role players are authorized to bring miscellaneous items that are used to enhance atmospherics (i.e. prayer rugs, tea pots, decorations, etc.) so long as they remain within the Decisive Action Training Environment (DATE 3.0) scenario standards. 4.4 The contractor is responsible for providing meals and drinking water to the COB teams. 4.5 Contractor Property: All contractor provided equipment shall be clearly marked and stored separately from U.S. Government property. Upon completion or termination of this contract, the contractor shall remove all contractor-owned equipment/property NLT 30 calendar days after the conclusion of the contract, or the government will properly dispose of the contractor’s equipment/property. PART 5 SPECIFIC TASKS The overall objective is for the contractor to provide realistic scenarios that emulate enemy forces that prepare Soldiers to be flexible, creative, and to evaluate real and potential threats in timely a manner. However, the contractor will ensure that safety is maintained while providing all scenarios within the contract period. 5.0 Simulated Enemy Forces 5.1 Requirements: The DATE 3.0 is the Training and Doctrine Command (TRADOC) standard for scenario-based training events. The contractor shall: 5.1.1 Understand the Contemporary Operating Environment (COE) described in DATE 3.0. 5.1.2. Meet all scenario timelines. Be at the right place, in the correct costume or clothing and prepared to execute the script. 5.1.3 Portray (acting) in a character role described by DATE 3.0. Use improvisational skills to improve training. Develop character characteristics such as family members, spouses, political affiliations, primary motivations and worldviews. 5.1.4 Provide Subject Matter Expertise (SME) on COE conditions in potential or current theaters of operation, manners, customs, uniforms and civilian clothing. 5.1.5 Combine and transition between non-combat roles of civilian, regular, irregular, or criminal forces. 5.1.6 Exert control over a small riot, crowd or demonstration. 5.1.7 Simulate injuries and reactions to injuries. Simulate death. 5.1.8 Physically capable of enduring extensive manual search while simulating death. 5.1.9 Captured role players will be secured and searched according to standard operating procedures (SOPs) according to the authorized Rules of Engagement (ROE). Civilians on the Battlefield must be physically capable of being taken captive, restrained, placed in restrain postures, extensively searched, and interrogated. 5.2 Contractor Manpower Reporting Application (CMRA) 5.3 The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Oregon National Guard via a secure data collection site. 5.4 The contractor shall completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs shall be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. Security Requirements 7.1All service providers shall be able to provide a valid driver's license, valid vehicle registration, and valid vehicle insurance to base security in order to gain access before gaining access to the site. All personnel will be subjected to a Law Enforcement Data System (LEDS) Background check. All individuals with unfavorable background checks will be banned from the installation. All contracted employees and subcontracted employees will be required to pass the required training below in order to come and go off site or maintain onsite for the duration of the requirement. Antiterrorism/Operations Security Requirements 8.1 AT Level I Training: All contractor employees, to include subcontractor employees, requiring access Army installations, facilities and controlled access areas shall complete AT Level I awareness training. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR and to the contracting officer, within ten (10) days of award. Contracting Officer’s Representative (COR): The ORNG Contracting Officer’s Representative for inspection and acceptance of deliverables under this task order, and will be physically located at the Event throughout the exercise period. The COR is authorized to represent the contracting officer in interpreting the technical requirements of this task order. However, the COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition. Deliverable Guidelines: Inspections and Acceptance: All deliverables must be submitted to and approved by the COR. Notice Regarding Late Delivery: The contractor shall notify the COR as soon as it becomes apparent to the contractor that a scheduled delivery will be late. The contractor shall include in the Problem Notification Report (PNR) the rationale for late delivery, the expected date for the delivery and the project impact of the late deliver. The contractor must include the DSR with each invoice submitted for payment to the COR. Develop and publish a formal plan to address procedures and resources available for on- site safety, ‘real-world’ emergencies and life support capabilities. Plan must be submitted to contracting within 10 days of award.
