The National Weather Service (NWS), located administratively within the National Oceanic and Atmospheric Administration (NOAA), intends to purchase maintenance and maintenance support services for seventeen (17) National Weather Service (NWS) NOAA Weather Radio (NWR) transmitter systems in the state of Ohio (OH). This is a combined synopsis/solicitation for commercial items prepared in accordance with FAR Part 13, Simplified Acquisition Procedures, as supplemented with FAR Part 12 Commercial Items and additional information included in this notice and the attached solicitation document. The State of Ohio, Emergency Management Agency (OHEMA) has been identified as the only known source that can provide the needed maintenance and maintenance support services that will also meet the Government’s intended use. This is a noncompetitive action. The Government intends to solicit and negotiate with only one source under the authority of 41 U.S.C. 1901, as implemented by the FAR 13.106-1(b)(1). In accordance with FAR 5.207(c)(15), the intended source is the State of Ohio, Ohio Emergency Management Agency (OHEMA). It is the Government’s intent to solicit and negotiate with the only known source (OHEMA) under the authority of FAR 13.106-1(b)(1)(i). The Justification for Other than Full and Open Competition (JOFOC) will be posted within 14 days after contract award in accordance with FAR 6.305(a). All proposals received prior to the close of this notice will be considered by the Government. However, this is not a request for proposals and there is no solicitation available at this time. The Government reserves the right to solicit quotes based on the receipt of affirmative responses to this notice or issue a purchase order to OHEMA, whichever is determined to be more advantageous to the Government without further notice. A determination by the Government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested firms shall include, in writing, the company name, address, point of contact, telephone number, and business size; a statement regarding their capabilities and qualifications; and sufficient information that describes or demonstrates the firm’s certification and authorization by OHEMA to perform the requisite services, including written confirmation from OHEMA. Interested parties may identify their interest and capability to respond to the requirement. This is not a request for competitive responses. However, all responses received within ten (10) calendar days after date of publication of this synopsis will be considered by the Government. The deadline for vendor questions is five (5) calendar days after the issuance date of this synopsis. Responses can be sent via email to: james.d.moore@noaa.gov. Responses shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items (or complete online at http://www.sam.gov). Only affirmative responses to this notice will be evaluated to the extent necessary for the Government to determine whether it is feasible to conduct a competitive acquisition considering demonstrated qualifications, knowledge, and experience. Submissions received in response to this notice shall be evaluated based on demonstrated technical ability to successfully provide the required services as stated herein. If no affirmative responses are received, the Government intends to award a contract to OHEMA. The DOC, NOAA, Eastern Acquisition Division-Kansas City Office requires that all contractors doing business with this office be registered with System for Award Management (SAM).
