Can the tower's payload and wind load exceed the maximum specifications? R2: Absolutely! I doubled checked my notes, and I actually made an error in the SON. It should have been Payloads up to 125 pounds, and a Maximum Wind Load (Sail Area) up to 18 square feet. I apologize for the error on my part. Q2. Do the length and width maximums listed under "trailer specifications" refer to the trailer frame dimensions? R2: Yes, the length and width listed under “trailer specifications” are the maximum trailer frame dimensions. The total (“transport”) length of the trailer and tower together should be a maximum of 18 feet. 2. Correct Clause 52.212-2 to read: (IX) FAR 52.212-2, EVALUATION – COMMERCIAL ITEMS (OCT 2014), applies to this acquisition. Offers will be evaluated based on price and the factors set forth in paragraph (a). (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers. This is an “all or none” request. This contract will be awarded as a firm-fixed price with payment terms of Net 30 on a Lowest Price Technically Acceptable (LPTA) basis. Paragraph (a) is hereby completed as follows: Evaluation will be based on Technical Acceptability. Trailer towers must meet or exceed all technical specifications listed in SON. Price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
