NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Eastern Region Acquisition Division (ERAD) and the Office of Marine and Aviation Operation (OMAO), using the procedures set forth in FAR Part 13, intends to negotiate on a sole source basis with Klein Marine Industries, Inc., located at 11 Klein Drive, Salem, NH, 03079 for a firm-fixed price contract for upgrades to proprietary sonar system on the NOAA Ship Thomas Jefferson. NOAA Ship Thomas Jefferson has four Klein 5000 Side Scan Sonar systems on board to conduct hydrographic surveys. The underwater towed sonar array (towfish) is a crucial part of the sonar system. Three towfish are currently using transducers that are beyond the 10 year expected life cycle. The systems are showing signs of performance degradation and are no longer reliable. Klein Marine Systems, Inc., is the sole proprietor of the Klein 5000 Side Scan Sonar systems, the Original Equipment Manufacturer (OEM). The equipment on the Thomas Jefferson has conditions of warranty which do not permit repairs or modifications by anyone other than the OEM. In order to maintain the functionality of this system, NOAA is looking for the OEM to provide the required upgrades. The North American Industry Classification System Code (NAICS) is 334511, Search, Detection, Navigation, Guidance, Aeronautical, Nautical System and Instrument Manufacturing. This notice does not constitute a solicitation-a Request for Proposal (RFP), Request for Quotation (RFQ), or an Invitation for Bid (IFB)-and it does not restrict the Government in any way regarding its ultimate acquisition approach. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
