FedBizOpps Announcement Type: Special Notice Classification Code: J Subject: Maintenance Support Services for Carl Zeiss LSM 800 Laser Scanning Confocal Microscope Introduction This is a notice of intent, not a request for a quotation. A solicitation document will not be issued and quotations will not be requested. Purpose The National Institute of Standards and Technology (NIST) intends to negotiate a firm-fixed priced contract on a sole source basis with Carl Zeiss Microscopy, LLC located at 1 Zeiss Drive, Thornwood, NY 10594-1939. The contract will be for preventative maintenance and service of an existing Carl Zeiss LSM 800 Laser Scanning Confocal Microscope for a base period of one year followed by four (4) subsequent one-year option periods. Authority This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 811219 - Other Electronic and Precision Equipment Repair and Maintenance with a size standard of $20.5 Million. Description The following services are required for the base period of performance and any option periods exercised: • The contractor shall provide full service preventative maintenance and repair support for the NIST's Carl Zeiss LSM 800 Laser Scanning Confocal Microscope. • Full service shall include an annual preventative maintenance service visit, ad-hoc service visits as required, and replacement parts. Scheduled and emergency services shall be performed between the hours of 8:00 AM and 5:00 PM Monday through Friday excluding holidays. • The contractor shall provide software version upgrades and updates as issued. • Services must be provided by a manufacturer-authorized factory-trained technician Sole Source Determination The sole source determination is based on the following: The NIST Engineering Laboratory (EL) Polymeric Materials Group owns and operates a Carl Zeiss Microscopy LSM 800 Laser Scanning Confocal Microscope (LSCM). The EL Polymeric Materials Group uses the microscope to study the durability and service life of polymer systems and engineering materials for resilience infrastructure applications. To ensure continuity of research efforts, it is important that the LSCM be maintained at full operational performance. Therefore, routine maintenance support services are required. The LSM 800 LSCM is proprietary to its original equipment manufacturer, Carl Zeiss Microscopy, LLC and maintenance support services may only be purchased directly from this contractor. Please see the attached sole source letter from Carl Zeiss Microscopy, LLC. No other contractor has the capability to service this proprietary equipment or to provide compatible replacement parts when needed. Use of any other contractor for the required support services would jeopardize equipment function and reliability. It would also risk creation of unacceptable disruptions in research activities. Accordingly, only Carl Zeiss Microscopy, LLC is capable of supporting this requirement and a sole source acquisition is necessary.
