A determination not to compete this proposed contract was made pursuant to the Federal Acquisition Regulation (FAR) 13.501(a). Due to the unique and highly specialized nature of this boat, only one source is capable of providing the supplies required at the level of quality required for the entire scope of work. The National Marine Fisheries Service (NMFS) Office of Law Enforcement (OLE), Pacific Islands Division (PID) has a requirement for a highly specialized 38FC patrol boat manufactured by SAFE Boats International. The exact hull design, capacity, and configuration is designed to include specialized law enforcement equipment required by PID (e.g. advanced communication systems, encrypted radios, searchlights, gun locks, workable deck configurations, law enforcement lighting, law enforcement siren/loudhailer systems, additional locker systems, thermal imaging systems, etc.). SBI vessels have proven performance, durability and safety measure records with OLE. Specialized SBI vessel features are required because of the varying and difficult environmental factors encountered in the Pacific Region. PID requires a proven all-weather patrol vessel, which will withstand the rigorous long distance and transverse waves among island channels. The vessel must also be able to successfully operate in the Pacific marine national monuments and sanctuaries. The boat will provide a required seamless addition to an already existing PID vessel of the same make and model. On its own, the single existing vessel is no longer able to perform the specialized remote marine law enforcement operations now required across the increased Pacific Islands Region. This procurement is being conducted under contracting by under FAR) 13.501(a). The North American Industry Classification System (NAICS) code for these item is 336612. This notice of intent is not a formal solicitation or request for competitive proposals. No solicitation document is available and telephone requests will not be accepted. No award will be made on the basis of quotations or offers received in response to this notice. Interested parties may submit their interest and capabilities no later than Thursday, August 20, 2020 by 2:00 p.m. Pacific Time.
