This is a notice of a proposed contract action in accordance with FAR 5.201. The Dept. of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Satellite and Information Acquisition Division (SIAD) intends to award a sole source, cost plus fixed fee-completion (CPFF-Completion) contract to L3Harris Technologies, Inc., to provide a Command and Control (C2) element for NOAA’s Space Weather Follow-On Ground Segment (SWFO GS) SWFO-L1 observatory. The intent is to develop, deploy, and provide operations support for the SWFO-L1 observatory’s C2 element. If awarded, the proposed SWFO-L1 observatory C2 element contract action will be awarded using Other than Full and Open Competition procedures citing the authority at 10 USC 2304(c)(1) as implemented by FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Responsible sources may submit a capability statement for consideration. This notice of intent does not constitute a Request for Proposal (RFP) for the SWFO-L1 observatory C2 element, nor does it restrict the Government as to its ultimate acquisition approach. The Government does not intend to award a contract on the basis of this notice nor will it reimburse firms for any costs associated with preparing or submitting a response to this notice. A NOAA-AGO Ombudsman has been appointed to consider and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. Concerned parties should first address their concerns, issues, disagreements, and/or recommendation to the Contracting Officer for resolution before consulting the Ombudsman.
