The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under the authority of FAR 8.405-6, with Ansys, Inc. for software and maintenance support services to consolidate and augment existing Ansys software licenses that are currently in use by NIST. ***** Sole source determination is based on the fact that the Ansys software packages that are currently licensed by researchers include Ansys’ HFSS, Ansys’ Lumerical along with additional Ansys packages related to each. These Lab-held licenses have separate technical support performance periods which each must be renewed in the coming months. The consolidation aspect of this procurement seeks to merge these distinct Lab-held licenses into a single centrally-managed portfolio and to have them all on a common performance period for annual technical support. Ansys, Inc. is the owner of all rights to the software and is the only vendor with the legal rights to publish and distribute these materials worldwide. Therefore, the Ansys, Inc. is the only vendor capable of meeting this requirement. Additionally, Ansys, Inc. provided a letter stating and confirming, “Ansys software and Ansys technical support is only available to National Institute of Standards and Technology directly from Ansys.“ The proposed contract is for sixteen (16) months. *****The North American Industry Classification System (NAICS) code for this acquisition is 513210, Software Publishers. ****** A determination by the Government whether to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. *****No solicitation package will be issued. This notice of intent is not a request for quotations. Interested parties that believe they can satisfy the requirements listed above must identify their capability in writing before the response date of this notice.
