The Office of Acquisition and Agreements Management (OAAM), Acquisition Management Division (AMD) of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole source basis, under the authority of FAR 13, with Bruker Nano Surfaces Business of Santa Barbara, CA, to acquire a comprehensive maintenance agreement. The MML Biomaterials for Oral Health Program mission is to enable the development and manufacturing of biomaterials for oral health moving forward in the 21st century by providing critical measurement methods and reference materials. Scientific focus is on the underpinning measurement science to assist the development of robust (repeatable and reproducible) testing methods and reference materials to support oral health. The NIST owned Bruker Nano Atomic Force Microscope, used to measure nanoscale changes in the adhesive interaction for use in prediction of anti-microbial, osseointegration, and remineralization performance of new class dental materials, requires maintenance services to maintain the manufacturer specifications. The total period of performance for maintenance shall be a base period of one-year and two one-year option periods. The NAICS code for this requirement is 811219 and the small business size standard is $20.5. Sole source determination is based on the following: Market research revealed that Bruker Nano Surfaces Resolve is the only source that can provide a commercially-available service maintenance agreement that meets NIST's minimum need by providing one preventive maintenance visit per year returning the system to manufacturer's specifications and an unlimited number of service calls in the event of instrument failure which require immediate repair. The required system is a commercial item, manufactured by Bruker Nano Surfaces Resolve. Bruker Nano Surfaces Resolve has proprietary rights to the required system and is the sole manufacturer and distributor of the system. Bruker Nano Surfaces Resolve has no authorized resellers or service providers, therefore, only they can supply the required service. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by July 9, 2019 will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
