The Office of Acquisition and Agreements Management (OAAM), Acquisition Management Division (AMD) of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole source basis, under the authority of FAR 13, with Kratos Analytical, Inc., to acquire a comprehensive maintenance agreement. The MML Materials Measurement Science Division supports the nation's materials science by providing measurements for the determination of composition, structure, and properties of a variety of materials; standard reference materials; state-of-the-art instrumentation; and basic measurement science research to support core capabilities and foster innovation. The NIST owned Kratos AXIS Ultra DLD system, used for high quality measurements for the multitude of research focuses, requires maintenance services to maintain the manufacturer specifications. The total period of performance for maintenance shall be a base period of one-year and two one-year option periods. The NAICS code for this requirement is 811219 and the small business size standard is $20.5. Sole source determination is based on the following: Market research revealed that Kratos Analytical, Inc. is the only source that can provide a commercially-available service maintenance agreement that meets NIST's minimum need by providing one preventive maintenance visit per year returning the system to manufacturer's specifications and an unlimited number of service calls in the event of instrument failure which require immediate repair. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by July 12, 2019 will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
