The Office of Acquisition and Agreements Management (OAAM), Acquisition Management Division (AMD) of the National Institute of Standards and Technology (NIST), on behalf of the Material Management Laboratory, Material Measurement Science Division (MML/MMSD) intends to negotiate on a sole source basis with Thermo Electron North America, for the repair and software upgrade of a NIST-owned TSQ Quantum Ultra Accurate Mass System, Serial Number: TQU01745. The Contractor shall repair the system, return the system to manufacturer's specifications. In September of 2020, NIST awarded contract number 1333ND20PNB640892 for maintenance and repair of NIST-owned equipment manufactured by Thermo Fisher. The Quantum Ultra Accurate Mass System was included on that contract, pending a pre-maintenance inspection and necessary repairs. The intended contract is for necessary repairs and software upgrade that were determined necessary during the pre-maintenance inspection. The Quantum Ultra Accurate Mass System is a commercial system that was manufactured by Thermo Fisher Scientific which is owned by Thermo Electron North America. Thermo Fisher has proprietary rights to the equipment and is the sole manufacturer and distributor of the equipment. Thermo has no authorized resellers or service providers, therefore, only they can supply the required service and guarantee that the maintenance and parts will be fully compatible with and meet the original performance specifications for the equipment. Only Thermo has access to performance verified component parts, spare parts, software, technical support, and the latest firmware and software updates available for these systems. Thermo is the only source that can provide the required repair consistent with the terms of contract number 1333ND20PNB640892. This notice of intent is not a request for competitive quotations; however, responses received by April 27, 2021, will be considered by the Government. Any party responding to this notice must provide written documentation that Thermo Fisher has agreed to work with the Contractor to provide the required parts and software updates required for this repair. A determination by the Government to compete this requirement based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to compete this requirement.
