Notice of Intent to Sole Source Maintenance of Asgard Emulator/SFTP and Open/A Web Software This synopsis is issued in accordance with FAR Part 5.203 in response to the mandatory requirement for notification. The purpose of this synopsis is to announce the United States Patent and Trademark Office’s (USPTO) intent to award a commercial, Firm-Fixed Price sole source purchase order to Asgard Software, Inc., 4942 NC-49, Harrisburg, NC 28075, in accordance with FAR 6.302-1, for maintenance and support of Asgard Emulator/sftp and Open/A Web software. Market research has demonstrated that there is only one vendor capable of fulfilling the USPTO’s needs. The vendor, Asgard Software, Inc. does not have any resellers authorized to maintain Asgard Emulator/sftp and Open/A Web software. The statutory authority for other than full and open competition is 10 U.S.C. 2304(c)(1), only one source and no other supplies or services will satisfy agency requirements. The NAICS code for this acquisition is 541519. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency for market research purposes. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government.
