The National Institute of Standards and Technology (NIST), located in Gaithersburg, MD has an on-going service requirement for the existing MANAKON System. MANAKON interfaces with the telephone system and collects and manipulates data for reporting. Contractor maintenance and service support is required to be able to run Call Detail reports to check for waste/fraud/abuse and to be able to comply with court orders as requested. The system is located within Office of Information Systems Management/Customer Access Support Division. Maintenance service will include Licensed Software and Associated Equipment identified in Exhibit A hereto and services requested by the Government and described herein. NIST intends to issue a firm fixed priced purchase order on a sole source basis to the following source: Graceful Websites located in Bealeton, VA. The proposed award is being issued in accordance with FAR Part 13.106 under simplified acquisition procedures and conducted under the authority of FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. The associated North American Industry Classification System (NAICS) Code is 541519 – Other Computer Related Services with a size standard of 150 employees. Justification TMA Net, Inc. (TMA) is the original and exclusive developer, supplier and copyright holder of the Manakon system which is licensed to and used by the NIST Office of Information Systems Management. Further, TMA is the sole and exclusive vendor authorized to provide maintenance and security administration support for this proprietary software. On January 1, 2022 TMA intends cease this portion of their operation. In order to provide for an orderly transition of clients still using TMA’s proprietary software, TMA intends to transfer sole and exclusive rights of their Manakon software to the following entity; Graceful Websites for the purpose of maintaining said Manakon software. At that point in time, Graceful Websites will have the exclusive rights to maintain and/or modify the Manakon software for the benefit of TMA’s licensees. THIS NOTICE OF INTENT IS NOT A REQUEST FOR QUOTES However, it is a market research tool being used to determine the availability and adequacy of potential sources. A determination by the Government not to compete this requirement based on responses to this notice is solely at the discretion of the Government. Interested offerors who believe they can provide the aforementioned item are invited to submit substantiating documentation in writing. The government will consider all responsible sources received by the due date. Written responses must contain sufficient documentation to establish a bona-fide capability to fulfill the requirement. If no written responses are received, a purchase order will be issued without further notice.
