(PPQ) in Idaho intends to secure services including all labor, equipment, supervision, transportation, operating supplies, and incidentals necessary for supplying 27,180.00 gallons of the chemical Telone II® (1,3-Dichloropropene 97.5 %, inert ingredients 2.5 %) to an application contractor performing fumigation treatments in Bingham County, Idaho, United States. The type and amount of equipment and personnel needed to accomplish the contract work is the responsibility of the Contractor. The work shall be done in strict compliance with the specifications provided by the Contracting Officer Representative and the terms, specifications, conditions, and provisions of this solicitation and Statement of work. USDA APHIS will solicit for an application contractor separately. This solicitation is for the transport, storage, and delivery of the chemical Telone II® (1, 3-Dichloropropene 97.5 %, inert ingredients 2.5 %). The Contractor shall be required to commence work under this contract as early as August 15, 2023, or upon official notification by the Contracting Officer. No application will be performed on Sundays unless otherwise approved by PCN program staff. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the U.S. Federal Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
