This Memorandum documents that the contracting officer did not identify any potential acceptable locations through advertisement or market survey and serves as the written justification to negotiate directly with the present lessor in accordance with GSAM 570.402-4, No Potential Acceptable Locations, and FAR 6.3, Other Than Full and Open Competition. GSAM 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition. The Government requires a new lease to properly execute a 20 year lease with termination rights after 1 year. Prior lease#1204H100L0232 was issued under the wrong authority, renewal actions did not occur properly, and rent adjustments are overdue. This new lease will remedy those problems.
