This is a combined synopsis/solicitation and the only solicitation for an IFB for Peanut Butter and Sunflower Butter, set aside for small business concerns, with offers requested and no separate written solicitation to be issued. Interested parties with concerns should first submit them to the Contracting Officer, who will make every effort to respond within 10 business days; Tier 1 engagement is not an official protest and does not pause the acquisition process, award decisions, or performance. If unresolved, an agency protest may be filed with the Contracting Officer or USDA Independent Review Authority, must state the elected forum and include FAR 33.104-4(a)(3) information, and should be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer. Agency protests must be filed within FAR 33.104 timeframes, and awards or performance will be suspended during the protest unless justified for urgent and compelling reasons or determined to be in the Government’s best interest. USDA strives to resolve agency-level protests within 35 business days, and protesters electing USDA review agree not to file the same matter with GAO or another external forum while the agency protest is pending.
