Formal agency protests may be filed with the Contracting Officer or the Ombudsman; awards or performance are suspended during the protest unless justified for urgent/compelling reasons or determined to be in the Government’s best interest. USDA aims to resolve formal protests within 35 calendar days of filing, and formal protests must include FAR 33.104(a)(3) information and meet FAR 33.104 timeliness requirements. Formal OPAP protests should be sent electronically to SPE.inquiry@usda.gov and the Contracting Officer, and filing with USDA precludes pursuing the same matter with GAO or another external forum while pending.
