USDA’s Ombudsman Program for Agency Protests offers an alternative dispute resolution path, encouraging interested parties to first raise concerns with the Contracting Officer and, if unresolved, contact the Ombudsman. Formal agency protests may be filed with the Contracting Officer or the Ombudsman, and contract award or performance is suspended during the protest period unless justified for urgent/compelling reasons or determined to be in the Government’s best interest. Formal protests should be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer, with the agency aiming to resolve protests within 35 calendar days of filing. By initiating a USDA protest, the protester agrees not to pursue the same matter with GAO or another external forum while the agency protest is pending.
