The notice is a combined synopsis/solicitation and the only solicitation for an invitation for bids to supply Canned Fruit, set aside for small business concerns, with FAR provisions and clauses incorporated by reference and available at www.acquisition.gov. Concerns should first be submitted to the Contracting Officer, who will make every effort to respond or resolve within 10 business days; Tier 1 engagement does not pause the acquisition process, delay award decisions, or suspend performance. If unresolved, an interested party may file a written agency protest with the Contracting Officer or USDA Independent Review Authority, including FAR 33.104-4(a)(3) information and submitting electronically to SPE.inquiry@usda.gov and the Contracting Officer within FAR 33.104 timeframes. USDA strives to resolve agency-level protests within 35 business days, and awards or performance are suspended during the protest period unless justified in writing for urgent and compelling reasons or the Government’s best interest. Filing a USDA protest commits the protester not to pursue the same matter with GAO or another external forum while the agency protest is pending.
