Interested parties with concerns should first contact the Contracting Officer, who will aim to respond or resolve the concern within 10 business days, and this Tier 1 step does not pause solicitation actions, delay award, or suspend performance. If unresolved, a written agency protest may be filed with the Contracting Officer or USDA Independent Review Authority, with the protester electing the forum; USDA strives to resolve agency-level protests within 35 business days. Contract awards or performance will be suspended during the protest period unless justified in writing for urgent and compelling reasons or determined to be in the Government’s best interest. By filing an agency protest, protesters agree not to pursue the same matter with GAO or another external forum while the agency protest is pending.
